1. Changes to Terms:
Our Terms and Conditions may be updated without prior notice.
Users automatically agree to any changes.
2. General Terms:
By downloading and using webcmsx, you confirm your agreement to these terms.
We are not liable for any direct, indirect, special, incidental, or consequential damages resulting from the use of materials on the site.
Seek support from webcmsx Community for the Open-Source Edition or the team of webcmsx for any service, repair, or correction needs for the Commercial License Edition.
3. webcmsx v.1.0:
webcmsx v.1.0 is delivered electronically via GitHub.
It operates under the terms of the MIT and CPAL 1.0 licenses.
While freely available for personal use and customization, redistribution claiming ownership is not permitted.
4. Intimation of Changes:
Any changes to our terms of use will be communicated on this page at our discretion.
5. Customization and Paid Support:
For customization, users can request paid services by contacting [email protected].
Engagements with developers from the Community are at the user's risk.
webcmsx or the team is not liable for any damages resulting from such engagements.
Refund Policy
License Fee Payment:
The Licensee must pay the one-time upfront fees, as specified on the ordering website, for the licenses and rights granted. The payment is to be made at the time of placing the order, with no credit allowed under any circumstances.
Non-Refundable Fees:
Once paid, License Fees are non-refundable. The Licensee, having seen a demonstration and satisfied with the product, receives the unencrypted complete source code after purchase. No refunds, returns, exchanges, or demo copies are provided. Questions or concerns should be addressed before purchase via email.
Termination Rights:
We reserve the right to terminate the license if the Licensee violates the License Agreement terms. The Licensee can terminate at its discretion by uninstalling the product, but no refund will be provided.
Technical Support and Refund Process:
If the product/module malfunctions on the Licensee's site, providing site access details (FTP and database information) is necessary for issue resolution. Failure to provide these details may result in an inability to process refund requests. Remote desktop tools other than FTP and admin login details are not allowed.
Pre-Purchase Considerations:
Before purchasing, the Licensee should thoroughly read product details and carefully review the DEMO. Only proceed with the purchase if completely satisfied with the product.

Software Customization Policy
Definitions:
Adiframe: Refers to Adiframe Limited.
webcmsx: Refers to webcmsx Software.
Customization: Denotes services adding functionality/features not in the base product, tailored to specific customer needs.
Module: A custom add-on module developed based on a customization request.
Ticket: Represents a customization request raised on the webcmsx Support Portal, specifying module details.
Module Development:
All customization services adhere strictly to the terms outlined in the webcmsx Software License Agreement.
Customization services are limited strictly to the scope specified in the 'Ticket' unless both parties agree in writing to expand it.
Customization Services:
Provided as per the 'Ticket' terms on webcmsx Support, contingent on full payment, adherence to schedules, and acceptance criteria (if specified).
Acceptance is deemed upon criteria completion, Adiframe's notification, or usage beyond testing.
Any changes post-'Ticket' execution necessitates a cost and delivery re-assessment, subject to mutual written agreement.
Term and Termination:
The term is determined by the specifics outlined in the 'Ticket' on webcmsx Support.
Termination may occur for cause, including material breach or insolvency, with payment obligations for services performed pre-termination.
Fees:
Fees are in accordance with the webcmsx Support fee schedule, with invoices providing a detailed breakdown of services, payable promptly.
Tax obligations fall under your responsibility.
Failure to pay may result in additional charges.
Intellectual Property Rights:
The owner of the Customization exclusively holds all intellectual property rights in the Customized Module.
The client's specific customizations will not become part of webcmsx's standard features.
No automatic incorporation of the customized Module into future webcmsx releases.
Limited Warranty and Limitation of Liability:
Limited Warranty: Services are provided professionally with no guaranteed results.
Limitation of Liability: Adiframe is not liable for certain defects and errors, and no implied warranties are provided.
Additional Terms:
Customization is identical to the discussed requirements; changes are treated separately.
One-month customization support is provided post-delivery; extended support is billed separately.
Cost excludes extension installation/exchange if not quoted within the project.
No file edits during customization; backup is advised.
Communication is strictly through the webcmsx Support Application, with no screen sharing.
Cost excludes free consulting beyond the project scope.
You are liable for changes affecting the template.
Adiframe is not responsible for damages during customization.
